The Tribunal was satisfied that as Head of Entity, the Head of Mission/Force Commander had delegated authority to reassign a staff member within UNIFIL under staff regulation 1.2(c). The Tribunal further found that maintaining a harmonious work environment and the prevention of prohibited conduct was a valid operational reason for reassignment. The application was dismissed.

Decision to  laterally reassign the Applicant from her position of Contracts Management officer at the FS-6 level  to the position of Procurement Officer at the same level.

Legal Principle(s)

Staff regulation 1.2(c) provides that staff members can be assigned by the Secretary-General to any activities of the Office. The reassignment of staff members comes within the broad discretion of the Organization to use its resources and personnel as it deems appropriate.
