Receivability – Outcome of management evaluation: Except in the case foreseen in article 8.1(d)(i)b of the Tribunal’s Statute, Applicants have to await the outcome of the management evaluation process before filing an application with the Tribunal.

Decision Contested or Judgment Appealed

On 25 July 2012, the Applicant sought management evaluation of the Administration’s decision not to complete the classification process and to take a proper classification decision in relation to his post. On the same day, he filed with the Tribunal his application, challenging the same decision. The UNDT, having determined that summary judgment was appropriate, rejected the application as irreceivable because the Applicant had failed to await the outcome of the management evaluation.
